The W-8BEN form is intended for all individual clients (who do not have tax residence in the United States and who are not citizens of the US) who obtain the so-called US source income, such as dividends paid by US companies and dividend equivalents paid on CFDs on US stocks and CFDs on ETFs registered in the US. W-8BEN is obligatory for such clients.

The W-8BEN form allows you to apply a lower tax rate (in most cases 15% instead of 30%) on dividend equivalents paid on CFDs based on US stocks or ETFs as well as on dividends paid by US companies. However the reduced tax rate results from the relevant agreement on the avoidance of double taxation concluded between the USA and the country of residence of the client and can be different than 15%.

The W‑8BEN form can be completed in the mobile app. Click the profile icon in the top left corner, then select the Personal Details tab. Scroll down to the bottom of the screen to see the status of your W‑8BEN form. By clicking on the icon, you can view the form’s expiration date or use the option to cancel it.

W-8BEN form is also available in the Client office -> My profile -> Profile Data -> Tax office /W-8BEN form.

Please be aware that the lower tax rate applies from the beginning of the month following the month in which the form was completed and approved as correct by XTB.

🚩🚩🚩 When the W-8BEN form comes into force we are forced to cancel your Pending orders (On instruments with a lower rate).

🚩🚩🚩Please be informed that W-8BEN form is valid for 3 years from the end of the year in which the form was completed. After 3 years you will have to fill the form again. You can renew the form up to 45 days before its expiration, and you will be notified in advance by email.

In case you will complete the form incorrectly, you will receive an error notification and will have the option to complete the form once again.
